LIMITED WARRANTY TERMS AND CONDITIONS

These terms and conditions are applicable on the Limited Warranty (the “Warranty”) for the tyre types mentioned in the table below (collectively the “Products”) manufactured and/or sold by Vredestein Tyres Ltd. (the “Company”) under the brand ‘Vredestein’ purchased from the Company and/or its authorized dealers/ distributors located in India and being used by the retail purchaser in India. This Warranty only applies to the original retail purchaser (the “Consumer”) seeking a new replacement tyre provided to be eligible for coverage under this Warranty, proof of purchase of tyre is required for any applicable coverage under the Warranty.  

Standard Coverage:

This is not a representation or warranty that a product cannot or will not suffer non-repairable damage or fail in service, including without limitation, due to puncture, snag, cut, bruise or impact break caused by road hazards. Products can and do suffer non-repairable damage and fail in service, including without limitation, due to puncture, snag, cut, bruise or impact break caused by road hazards, as well as other factors. You remain responsible for proper use, maintenance, and removal from the service of your products.

Any implied warranties of merchantability or fitness for any particular purpose are limited to the duration and limitations of this express warranty and are otherwise fully disclaimed. No other warranty or representation of any kind is made by the company or shall be implied by law.

Eligibility:

All Products manufactured and/or sold by the Company are warranted against failure on account of any manufacturing defects (defective material/manufacturing/faulty workmanship) until the exposure of the Tread Wear Indicator (TWI) or the warranty period for the particular category of Product as prescribed in the table above, whichever is earlier. The original tread life of a Product ends when the tyre tread has worn down to the TWI, at which point the Product is considered fully worn out and rendered full service. 

Any complaint shall be subject to a thorough inspection by the Company’s authorized personnel. Post inspection, if the Company’s authorized personnel ascertains that there is a defect in the Product and if the Product is found to have failed due to manufacturing defect (defective material/manufacturing/faulty workmanship), the Product will be replaced on a pro-rata basis based on the Tread Wear Indicator. The price applicable for working out the amount payable on pro-rata basis will be as applicable on the date of exchanging the new tyre on pro-rata replacement.

In case where the exact claimed tyre is not available for replacement during the warranty period due to any reason, suitable product with available appropriate size/ pattern will be offered as replacement during warranty period. The price difference applicable for the replaced Product shall be borne by the Consumer.

Exclusion from Warranty

1. Road hazard injury (e.g., a cut, snag, scratches, penetrations, impact damage or puncture); 

2. Improper mounting or dismounting of the Product, tyre/wheel assembly imbalance;

3. Improper retread or repair, or repairs/ retreating that has failed;

4. Improper maintenance, racing, underinflation, overinflation or other abuse/operational damages resulting in casing damage or fatigue;

5. Accident, fire, chemical corrosion, contamination, tyre manipulation;

6. Improper storage;

7. The addition of liquid, solid or gaseous materials other than air or nitrogen;

8. Uneven or fast wear caused by mechanical irregularity in the vehicle, such as wheel misalignment, use of improper wheel, mechanical failure including without limitation failed shocks, struts, alignment, or balancing, or contact with vehicle components including without limitation fenders, exhaust system, or springs; resulting in damage to the under-tread, carcass or steel belts in radial/nylon breakers in bias tyres;

9. Conditions resulting from other consumer damage, such as (i) improper tyre and/or vehicle maintenance; (ii) misuse; (iii) abuse; (iv) overloading; (v) failure to follow recommended rotation practices; (vi) high speed spin-up; or (vii) accident, collision, impact with another vehicle or animal, fire, or chemical corrosion;

10. Products used beyond their life span;

11. Improper use of vehicle, including vehicle used for testing purpose, racing and/or other motorsports; 

12. Continued operation of vehicle with flat tyre or severely under inflated tyre; 

13. Improper application of size of Products and/or specification; 

14. Mechanical irregularities in the vehicle, such as misalignment, worn or faulty components, and bent wheel assemblies resulting excessive and irregular tread wear; 

15. Willful damage to the Products;

16. Use of after-market additives, such as fillers, sealants, or balancing substances, where the added materials are the cause of a failure; 

17. The Product’s serial number is tampered or altered;

18. Use of improper/repaired inner tube; 

19. Use of non–approved rims; 

20. Normal wear/tear and deterioration of the surface appearance;

21. Tyres purchased from unauthorized dealers/distributors; 

22. Ignoring service advice, deliberate act, misuse, mishandled, abuse or neglect, modifications carried out by unauthorized service dealer or persons; and

23. Tyres used outside India. 

General Terms & Conditions: 

1. This Warranty does not provide compensation for any applicable taxes on the new Product or for any indirect damages including but not limited to service charges incurred, charges of mounting/demounting, balancing of wheel, loss of time or loss of use of vehicle, inconvenience or consequential damage in so far as the law permit. 
2. Consumer has to pay the cost of mounting/demounting, inflation pressure filling, balancing, and any other service charges and applicable taxes.
3. The Products shall be covered under this Warranty for manufacturing defects, as mentioned in the warranty period table above, from the week of production.
4. The decision by the Company’s authorized personnel shall be final and binding on all concerned
5. The Products presented for warranty claim will remain the property of the owner/consumer, and the Company accepts no responsibility for loss of or damage to the Products. 
6. The Products rejected for warranty claim if not collected within twenty-one days of intimation, will be disposed off in the Company’s sole discretion. Thereafter, the Company and its authorized dealer/ distributor will not be liable for any loss thereof
7. As the durability of tyres and/or expected service life of tyres depends on uncertain factors such as terrain / load / speed / driving habits, maintenance of proper inflation pressure, vehicle condition, vehicle maintenance practices, etc. the minimum mileage obtainable from a tyre cannot be warranted.
8. The Products accepted under the Warranty will become property of the Company.
9. This Warranty is extended only to the original Consumer. This Warranty is not transferable. 
10. The Company’s liability under this Warranty is limited to the cost of the Products only and other vehicle components will not be considered.
11. No representative, employee, or dealer/ distributor has the authority to make or imply any representation, promise or agreement on behalf of the Company, which in any way varies the terms of this Warranty.
12. All Consumer complaints may be registered through Vredestein Tyres Customer Care on E-mail: customersupport@vredestein.com or can reach to the nearest Vredestein Tyres authorized dealer/distributor with the necessary proofs like vehicle registration certificate, OEM’s ancillary job letter, OEM’s pre-delivery inspection report, etc. (any one document is must for validation and complaint verification), warranty form and original proof of purchase of invoice. Consumer’s may ask that the Products are physically submitted to the Company’s sales office along with the warranty number given at the time of warranty registration / original equipment manufacturer (“OEM”) invoice along with OEM docket letter in case of OEM fitted tyres/invoice copy duly stamped by the Company’s authorized dealer/Company copy of dealer docket letter/digital docket reference number.
13. Limitation of damages: In no event and under no circumstances, including for breach of warranty, negligence or other tort, on any product liability and/or strict liability theory, or any other theory of liability, shall the company be liable to you or any other person or entity for any loss of use of vehicle and time, indirect, special, incidental, consequential, lost profit, loss of business, loss of goodwill or reputation, punitive or other damage, cost (including for replacement transportation), expense, or loss of any kind.
14. The Company reserves the right to modify/change entirely or cancel the terms/conditions contained in this Warranty without any notice in advance.
15. This Warranty is applicable only in India and is subject to Indian laws. In case of any dispute, the courts of Delhi shall have jurisdiction to settle such dispute.
